Accredited Franchise Companies

Australian franchisees are protected by a comprehensive regulatory regime. The (Commonwealth) Trade Practices Act 1974 protects against unconscionable, misleading or deceptive business conduct.

Franchisees are further protected by the mandatory Franchising Code of Conduct, which is underpinned by the Act. The Code regulates franchising conduct in three areas:

• Prior disclosure of relevant information.
• Dispute resolution.
• Mandatory standards, including a 7 day "cooling off" period after signing the franchise agreement, during which you can terminate the agreement for any reason.

However, the legislation does not, and naturally cannot, remove the commercial risk inherent in any business activity. What's more, there will always be a few franchisors seeking to trade off the reputation of franchising without the ability to deliver on its promise.

Which is why you need to properly research any franchise you're considering. To that end, the Code helps ensure the provision of better information by franchisors, to enable you to make a more informed decision.
